By booking and staying in any property of SHWAY BV in Antwerp, you agree to accept our terms and conditions stated below. 

 

Website Use
Use of this website is subject to the terms and conditions outlined below. By using this website you agree to be legally bound by these terms and conditions. Users enter site at own risk.
All rates quoted are subject to availability and alteration and may be subject to a minimum night stay. All discounted rates quoted are limited offers and subject to availability and/or a minimum night stay. While every effort has been made to ensure the accuracy of all information, www.shway.be cannot be held liable for any errors or omissions and reserves the right to change information and descriptions of listed accommodation and products. 

 

Online Bookings
Please note that different terms, conditions & cancellation policies in relation to all online bookings via www.shway.be may apply depending on the accommodation or rate type selected. Please read carefully the accommodation rate details that are provided before you make your booking. You are advised to check thoroughly the rate details before making your online reservation. 

 

Limitation of Liability
SHWAY BV cannot be held liable for any direct or indirect damage that may arise as a consequence of the client's use of the apartment, including and without limitation, damages, insurance, losses because of fire, robbery or criminal behavior. 

 

Reservation
Your reservation is made directly with SHWAY BV. By confirming your reservation with www.shway.be you are entering into a contract with SHWAY BV. 

 

Payment
A full pre-payment of the total cost of the booking is required at the time of making the reservation. You will receive an electronic confirmation of your booking when the full pre- payment is charged successfully from your credit card. The full pre-payment will be charged at least 90 days prior to arrival. 

With confirming your booking you automatically authorize SHWAY BV to charge your credit card. In case your credit card cannot be charged, SHWAY BV will contact you to provide new credit card details to settle the payment. 


Security Deposit
Together with the full pre-payment, the refundable deposit of 150 euros per property is charged from your creditcard. It will be charged back to your credit card automatically within a maximum of 14 days from the check in date on the conditions that:
(1) no damage to the apartment(s) has occurred, by any guest in the party
(2) no damage to any property has occurred, by any guest in the party
(3) no undue disturbance to other guests or residents has occurred, by any guest in the party
(4) no use of drugs has occurred in and around the premises of the apartment by any guest in the group.
(5) there has not been smoked inside the property and building of the property, by any guest in the party.
(6) no form of prostitution or criminal activities have been taken place inside the property and building of the property, by any guest in the party. 


If this cost exceeds the value of the deposit, SHWAY BV reserves the right to charge the excess to the guest's (or guests') credit card(s).
If SHWAY BV receives serious complaints or any disputes arise, they reserve the right to terminate your stay without notice. 

 

Check-in & Check-out Time
You must comply with the rules for checking-in and checking-out. If there is any delay in vacating the apartment beyond the agreed time, a full day's rental may be charged to you. Daily check-in time is from 2 PM and check-out is until 11 AM. 

Early check-ins and late check-outs must be agreed in advance with SHWAY BV. 

 

Cancellation
To cancel a reservation, please contact SHWAY BV as soon as possible by email, quoting your booking reference number (also contained within our email). If you need to cancel a booking urgently and it is outside office hours, we advise you to inform SHWAY BV directly using the contact details you will find on the confirmation email. 

Any cancellation may be liable to pay cancellation charges. Depending on the reasons for your cancellation, you may be able to reclaim these cancellation charges from your insurance company, if you have taken out travel insurance. We strongly recommend that all clients obtain appropriate travel and personal insurance cover. 

 

Cancellation policy and fees
Bookings cancelled or modified up to 5 days before the start of the stay a 100% refund is applicable.
Bookings cancelled or modified within 5 days and up to 24 hours before the start of the stay no refund is applicable. 

SHWAY BV reserves the right to cancel or alter the booking if:
1. The apartment(s) or part of it is not available due to Force Majeure.
2. SHWAY BV becomes insolvent or enters into liquidation or receivership.
3. The guest (s) are not able to show valid ID.
4. The guest (s) are not able to provide a security deposit.

SHWAY BV cannot be held liable for any delay, loss, damage or expenses incurred if your booking needs to be altered or cancelled neither when SHWAY BV is unable to live up to the contractual obligations as a result of events beyond his reasonable control, which include but not be limited to events such as war, civil strife, terrorist activity, labor disputes, natural or man-made disaster, fire, flood, adverse weather conditions and local regulations. 


Alterations
If for any reason you wish to alter your booking (e.g. change the dates of your stay or the accommodation requested), SHWAY BV will investigate all possibilities to comply with your request, however no guarantee can be given. In case no suitable alternative is available, the cancellation policy is applicable. 

 

Apartment
In the unlikely event that SHWAY BV does not, for any reason, have the required number and types of rooms available as per the booking, the company reserves the right to relocate the booker. 

 

Occupants
Only persons notified to SHWAY BV upon arrival and registered in the check form, may occupy the apartment. You may not re-let/sublet the apartment to any other third party without prior and specific written approval from SHWAY BV. The number of persons permitted to occupy the apartment is limited to the number of max persons as stated on www.shway.be and this limit may not be exceeded without prior written approval from SHWAY BV. SHWAY BV reserves the right to refuse admittance to the apartment if this condition is not met. 

 

Behavior
You are responsible for the correct and decent behavior of all the persons in the party. Should that person, or any of the persons accompanying him/her not behave in a suitable and responsible way, SHWAY BV shall be entitled to request the client and the persons accompanying him/her to leave the apartment without the right to claim any type of compensation. Drugs are strictly prohibited in and around the premises of all properties. In some properties it is allowed to smoke tobacco on the balcony, patio or roof terrace. It is never allowed inside the properties. 

 

Damage
SHWAY BV is not responsible for any loss or damage to your goods or personal belongings kept at the accommodation. You are also responsible for taking all-reasonable care of the apartment and its contents.
Except in the case of normal wear and tear, you are responsible for any damage to the apartment or its contents during your stay, which has occurred due to the negligence, willful default or irresponsible behavior on the part of yourself or those occupying the apartment or your guests. Any damage must be reported to SHWAY BV without delay. 

 

Fair Use
You and your party agree to be considerate tenants and will take good care of the apartment(s) and leave the apartment(s) in a clean and tidy condition at the end of the rental period. You and your party also agree not to act in any way, which would cause disturbance to those residents in neighboring properties. 

 

Force Majeure
All property rentals on this site are subject to the local laws and legal conventions of the country SHWAY BV origins from.
Such laws may change without notice. In the event that new or existing laws governing the short-term rental of properties, which may have an adverse effect on such rentals (including, but not limited to prohibition of such rentals), come into effect, the Local Apartment Operator will endeavor to relocate any pending arriving parties in alternative accommodation (to a similar standard). 

In the event that relocation is not possible, or undesired, SHWAY BV will refund any monies paid for affected accommodation booked through our booking agent.
SHWAY BV will not accept responsibility for the enforcement, amendment or introduction of such laws, and no compensation (beyond refunding of deposits) will be entertained. 

 

Adjustments
We reserve the right to update any of its terms and conditions at any time, as may be required and as may be in line with the company's business. The onus is placed on all parties using the website to undertake adequate measures to ensure that they visit any such terms and conditions on a regular basis. By agreeing to use our booking websites, it is implied that any such third party accepts any such changes and that any such third party undertakes to comply with any such changes. 

 

Prostitution
It is strictly forbidden to practice any form of prostitution from the properties of SHWAY BV. If there are suspicions for this, SHWAY BV has the right to inform the police to intervene and to immediately remove the party from the properties of SHWAY BV. 

 

Applicable law and competent court
Belgian law applies to all offers and agreements of SHWAY BV. Disputes between SHWAY BV and the customer will be exclusively submitted to the competent court in the Antwerp district.
